§ 50-262. Intoxicating liquor events at the Agri-Business Building.

  • As authorized by section 6-2, alcoholic liquor and/or cereal malt beverage may be consumed within the Agri-Business Building during permitted events, in accordance with the rules and regulations on file in the city clerk's office, and under the following conditions:

    (1)

    Any person proposing to utilize the building for such purposes shall apply to the city clerk for a consumption permit at least ten days prior to the event, and pay the daily permit fee as set by the board of city commissioners.

    (2)

    Consumption or possession of alcoholic liquor and/or cereal malt beverage may not exceed three consecutive days.

    (3)

    The permit holder shall comply with the following restrictions:

    a.

    No consumption or possession of alcoholic liquor and/or cereal malt beverage may occur between the hours of 12:00 midnight and 10:00 a.m.

    b.

    No person under 21 years of age shall be permitted within the interior of the agri-business building during the event.

    c.

    The permit holder shall provide security approved by the police chief or his designee in the form of an off-duty, uniformed police officer or a uniformed security officer.

    d.

    Any violation of this Code and/or state law on the premises during the event may result in immediate revocation of the consumption permit by the chief of police, or his designee.

    (4)

    Limitations. This section specifically does not authorize:

    a.

    Consumption or possession of alcoholic liquor and/or cereal malt beverage outside of the agri-business building or its surrounding curtilage; or

    b.

    Any selling of alcoholic liquor and/or cereal malt beverage or other activities regulated by chapter 6 of this Code and state statute.

    (5)

    Consumption permit fee. Any person wishing to obtain a consumption permit authorized by subsection (1) of this section shall pay a permit fee set by the board of city commissioners.
