§ 50-223. Encroachments.

  • All buildings, signs, canopies, awnings, awning posts, ropes, networks, advertising devices, posts or radio aerials placed in or projecting over or across or encroaching upon any street, avenue, alley or sidewalk are prohibited, unless constructed and maintained under the conditions imposed by this Code. When any such structure or thing exists, the board of city commissioners may, by resolution, declare such structure or thing a nuisance and order its removal and abatement. The police chief or his designee shall give the owner or occupant of the grounds fronting thereon, or the person causing such violation, a written notice that such violation must be removed or abated within three days, and if such violation is not removed and abated within the three days, he shall cause it to be removed and abated, and shall report the cost thereof to the city clerk, and the cost of removal or abatement shall be charged against the owner or occupant of the lot or parcel of ground fronting on such violation or the expenses may be collected from the person causing such violation.
